No statewide license is required. However, process servers working in New York City (Manhattan, Brooklyn, Queens, the Bronx, and Staten Island) who serve 5 or more processes per year must be licensed by the NYC Department of Consumer and Worker Protection (DCWP) under NYC Admin Code §20-403. NYC licensing requires an exam, a $10,000 surety bond, fingerprints, a background check, and GPS tracking devices for service. Outside NYC, no license is required.
Routine process service in New York typically costs between $75 and $150. New York City metro area serves average around $95, with Staten Island and Nassau County around $125. Upstate cities like Buffalo and Rochester are generally less. Request bids from multiple verified servers on the Mighty Process Server platform.
Under CPLR 306-b, service must be completed within 120 days after filing the summons and complaint. If service is not made within this period, the court may grant an extension for good cause or in the interest of justice. If the statute of limitations expires within 4 months or less after filing, the court may allow 15 extra days.
Any person 18 or older who is not a party to the action may serve process in New York outside of NYC. Within New York City, servers who serve 5 or more processes per year must be licensed by NYC DCWP under the NYC Administrative Code. Attorneys and government employees are exempt from the NYC licensing requirement.
If personal delivery cannot be completed, New York allows substitute service at the defendant's dwelling or business plus mailing (CPLR 308(2)). After due diligence, "nail-and-mail" service — affixing to the door plus mailing — is available under CPLR 308(4). Court-ordered service under CPLR 308(5) is available when other methods are impracticable.
