About Process Serving in South Dakota
South Dakota has an unusual requirement for process servers: they must be an elector — a registered voter — of any state at the time of service, in addition to being a non-party, under SDCL § 15-6-4(c). Service may not be made on Sundays under SDCL § 1-5-2. There is no fixed deadline to complete service, but service must be made with reasonable diligence.
